The rules for using List It Jamaica: what you may list, what we check before it goes live, what we do when something goes wrong, and where responsibility sits between you, other members and us.

These Terms form a binding agreement between you and us. By registering, listing, bidding, making an offer or simply browsing, you accept them. If you do not accept them, please do not use the site.

1. Who we are, and what this site is

List It Jamaica is an online marketplace where people and businesses in Jamaica advertise, browse, bid on and buy vehicles, property, equipment and general goods. It is operated by List It Jamaica.

We are a venue, not a dealer. We do not own, inspect, store, ship or sell the items listed here. When you buy something, your contract is with the seller, not with us. What we do is operate the platform, review listings before they are published, and police conduct on it.

In these Terms, "we", "us" and "our" mean List It Jamaica. "You" means anyone using the site. A "member" is someone with a registered account. A "listing" is an advertisement placed on the site. A "showroom" is a branded seller page.

2. Eligibility

You must be at least 18 and legally capable of entering into a binding contract under Jamaican law. Buying and selling here creates real obligations, which is why there is an age floor.

If we find that someone under 18 has registered, or that a member gave a false date of birth, we will close the account. If you believe a child has registered, tell us using the contact route in section 22.

You may not use the site if we have previously terminated your account, unless we agree in writing that you may return.

3. Your account

Register with accurate details and keep them current. An account is personal to you and may not be sold, shared or transferred.

Keep your password to yourself. You are responsible for what happens under your account, unless you told us it was compromised and we failed to act. Tell us promptly if you suspect unauthorised access, and we will help you secure it.

One person or business, one account, unless we agree otherwise in writing. Multiple accounts used to bid on your own items, manipulate feedback or evade a suspension are a serious breach of these Terms.

You may close your account at any time from your account settings. Closing it does not cancel obligations you have already taken on, such as completing a sale you have agreed.

4. Listing an item

Every listing is reviewed by an administrator before it becomes publicly visible. Nothing you submit goes live automatically. We may approve it, ask you to change it, or decline it. We aim to review submissions within  24 hours on working days.

Review is a safeguard, not a guarantee. We check listings against these Terms and against the prohibited list in section 5. We do not inspect goods, verify ownership documents, test mechanical condition or confirm that photographs show the actual item. Approval means a listing passed our review. It is not an endorsement, a valuation, or a warranty of any kind.

When you list an item you confirm that:

Listings run for the period shown when you create them and may be closed early by you, subject to section 8 where a buyer has already committed. We may edit a listing's category or formatting, but we will not rewrite your description or change your price.

5. Items you may not list

The following are prohibited outright. Listing them will get the listing removed and may get your account terminated and reported.

Restricted, meaning allowed only where the seller holds the relevant authority and says so in the listing: alcohol, tobacco, live animals, agricultural products subject to quarantine, and anything requiring an import permit.

If you are unsure whether something is allowed, ask us before listing it. That is always cheaper than having the listing pulled.

6. Vehicles, property and repossessed assets

Vehicles are the largest category on this site, so they carry extra rules.

Vehicles. You must be able to produce the title, certificate of fit, registration and any import documentation on request by a genuine buyer. State the mileage honestly and to the best of your knowledge. Disclose accident damage, flood damage, outstanding finance, and any lien over the vehicle. Do not list a vehicle you do not have the right to sell.

Property. You must be the owner, or the owner's authorised agent. State clearly whether you are advertising a sale or a rental, and if a rental, the term and what is included.

Repossessed and reclaimed assets. These may be listed only by the financial institution that holds the security, or by an agent it has authorised in writing. The listing must say plainly that the asset is repossessed and describe its condition honestly. Buyers should understand that such assets are typically sold as seen.

7. How you must behave

Use the site lawfully and in good faith. In particular, do not:

8. Buying, bidding and making offers

A bid is a commitment. If you place the winning bid on an auction listing, you are agreeing to buy that item at that price. Bids may only be retracted in genuine circumstances, such as a material error in the amount or a listing that has been substantially altered after you bid.

An offer is an invitation to deal. Making an offer does not bind you or the seller until the seller accepts it. Once accepted, both parties are expected to complete.

Buying outright at a stated price creates a contract with the seller immediately.

A seller who accepts a bid or an offer is expected to honour it. A buyer who commits is expected to pay and collect. Persistent failure to complete, on either side, is a breach of these Terms and may end your account.

Inspect before you buy where you can. On vehicles and property in particular, arrange to see the item and check documents before any money changes hands.

9. Paying for items

List It Jamaica does not process payments. There is no card checkout on this site. We do not collect, transmit or store card numbers, security codes or banking credentials, and no payment processor operates on our behalf.

Payment is arranged directly between buyer and seller, by cash, bank transfer, deposit or whatever else the two of you agree. We are not a party to that arrangement. We do not hold funds in escrow, and we cannot reverse, refund, recover or guarantee a payment.

Because of that, take ordinary precautions. Meet in a safe public place, or at a dealer's premises. Be wary of any request to pay in advance, to send money to a third party, or to use an unusual payment method. Never send a deposit for an item you have not seen.

10. Contacting other members

You can message members through the site. Sellers may also choose to display a phone number, and to indicate that the number accepts WhatsApp.

Use those channels for the transaction. Do not use a phone number or WhatsApp contact obtained here to send marketing, to harass anyone, or for any purpose other than dealing with the item.

Conversations that move to WhatsApp, phone or email leave our platform. We cannot see them, moderate them or produce them as evidence later. If a deal matters to you, keep the substance of it in site messages where there is a record.

11. Showrooms and business sellers

If you sell as a business, register a business account and open a showroom. Showrooms are reviewed before activation.

Business sellers must trade under their real registered name, comply with consumer protection law, and honour any warranty, return or cooling-off rights their buyers have by law. Nothing in these Terms reduces a consumer's statutory rights against a business seller.

12. Fees

Listing on List It Jamaica is currently free. We do not charge to register, to list an item, or to complete a sale.

We may introduce optional paid services in future, such as showroom subscriptions or featured placements. If we do, the price and terms will be shown before you commit to anything, and no charge will ever be applied to an existing free service without notice under section 21.

We earn revenue from advertising displayed on the site. See section 17.

13. Your content, and who owns it

Your listings, photographs, descriptions and messages remain yours. You keep ownership of them.

By posting content you give us a non-exclusive, royalty-free licence to host, display, reproduce and distribute it for the purpose of operating and promoting the marketplace. That includes showing your listing on the site, in search results, in our social media and email, and in product feeds we supply to services such as Google and Meta so that listings can be found. This licence lasts while your content is on the site and for a reasonable period afterwards in backups and archived records.

You confirm that you own the content you post or have permission to use it, and that publishing it does not infringe anyone's rights. Do not use photographs taken from another seller's listing, a manufacturer's website or a stock library without the right to do so.

The site itself, including its design, software, database and branding, belongs to us and may not be copied or reused without permission.

If you believe your copyright or trade mark has been infringed by something on this site, tell us using the route in section 14. Identify the work, identify the listing, and confirm you are the rights holder or authorised to act. We will remove or disable infringing content promptly and tell the member why.

14. Reporting a problem, and what we do about it

Report anything that looks wrong: a suspicious listing, a scam attempt, stolen goods, offensive material, abusive messages, or a member who will not complete. Email [email protected] with the listing ID or username and what you saw.

What we undertake to do. We will acknowledge a report within 2 working days and investigate it. Where a listing appears to be illegal, obscene or fraudulent, we will remove it from public view while we investigate rather than waiting for the outcome. We will tell you the result of a report you made, so far as we properly can without disclosing another member's personal data.

Where there is evidence of criminal activity we will preserve it, cooperate with the police and with the relevant authorities, and respond to lawful requests for information.

If you are the subject of a report, we will normally tell you what has been alleged and give you a chance to respond before we take permanent action, unless the matter is urgent, involves a risk to someone's safety, or telling you would prejudice an investigation.

15. Suspension and termination

We may remove a listing, suspend an account, or terminate access where:

Normally we suspend first and investigate, rather than terminate outright. We will tell you what the problem is and give you a reasonable opportunity to explain or put it right. Immediate termination without notice is reserved for serious cases: criminal conduct, material involving a child, a genuine risk to another member's safety, or repeated breaches after warning.

If your account is terminated you may not re-register without our written agreement. If you think we got it wrong, say so using the contact route in section 22 and a person will review the decision.

You may close your own account at any time, as set out in section 3.

16. Feedback and ratings

Feedback must be honest and based on an actual dealing. Do not post feedback that is abusive, defamatory, or designed to extract something from the other party. Do not trade, buy or manipulate feedback.

We do not ordinarily edit or remove feedback simply because it is unfavourable. We will remove feedback that breaches these Terms, contains personal data, or is plainly not about a real transaction.

17. Advertising on the site

Pages on List It Jamaica carry third-party advertising, currently supplied through Google. Those adverts are selected by the advertising network, not by us, and appearing here is not an endorsement by us of any advertiser, product or service.

Dealings you have with an advertiser are between you and them. Advertising also involves cookies and tracking by third parties, which is explained in our Privacy Policy.

18. What we are and are not responsible for

What we take responsibility for. Operating the platform with reasonable skill and care. Reviewing listings before publication as described in section 4. Acting on reports as described in section 14. Handling personal data as described in our Privacy Policy. Giving notice before we change these Terms or introduce charges.

What we cannot take responsibility for. We are not a party to transactions between members, and we do not control what members do. Accordingly we do not guarantee:

Dealing with people you have not met carries risk. Take sensible precautions: inspect the item, check documents, meet somewhere safe, and be sceptical of a deal that looks too good.

The site is provided on an "as is" basis. We do not promise it will be uninterrupted or error free, though we work to keep it available.

19. Limits on liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited under Jamaican law. Nor do these Terms reduce any statutory right you have as a consumer.

Subject to that, and to the fullest extent the law permits:

Indemnity. If a third party brings a claim against us because of something you did, specifically your breach of these Terms, your infringement of someone's rights, or your unlawful conduct, you agree to cover our reasonable losses and legal costs arising from it. This does not apply to the extent the claim results from our own act or omission, and we will tell you promptly about any such claim and give you a reasonable opportunity to participate in its defence.

20. Privacy

How we collect, use, share and protect personal data is set out in our Privacy Policy, which forms part of these Terms. It explains what other members can see, what remains private, the advertising and analytics providers operating on the site, and the rights you have under the Data Protection Act, 2020.

21. Changes to these Terms

We update these Terms as the platform and the law change. The effective date at the top always shows the current version.

For material changes, meaning anything that meaningfully affects your rights or obligations, including the introduction of fees, we will give notice by email to registered members or by a notice on the site at least 60 days before the change takes effect. Continuing to use the site after that date means you accept the updated Terms. If you do not accept them, close your account before the change takes effect.

Minor corrections, such as fixing a typing error or clarifying wording without changing its meaning, may be made without notice.

22. Governing law, complaints and contact

Governing law

These Terms are governed by and construed in accordance with the laws of Jamaica. Any dispute arising out of or relating to these Terms, or their breach, termination, enforcement, interpretation or validity, is subject to the exclusive jurisdiction of the courts of Jamaica.

If we disagree

Come to us first. Most problems are resolved faster by a direct conversation than by anything formal, and we would rather fix it than argue about it. Nothing here prevents you from taking a dispute to the Consumer Affairs Commission, to the Office of the Information Commissioner in a data protection matter, or to the courts.

General

If any provision of these Terms is found unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not waive our right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours if the business is sold, and your rights will not be reduced by that. These Terms, together with the Privacy Policy, are the entire agreement between us about the site.

Automated mail from the platform is sent from [email protected]. That mailbox is not monitored, so messages sent there will not reach anyone.
